At that time there were two
manufacturers of plate processing machines that would provide the
end product we desired to provide. After approaching both, the
latter (franklin) claimed they could do thicker materials as well as
numerous other claims. The first, Peddinghaus, had installations in
Arizona which we had seen in operation. We visited the fmi facility,
confidently disclosed our business plan, disclosed our risk the
venture would be if their machine could not do what they represented
it could do. One of the very important aspects of the venture we
disclosed to them was that we needed to get the machine installed
and running to capture the market before other industry experts
realized the potential market available and were able to enter the
market at the same time.
Just after the machine was delivered we began to see advertisements
from fmi appear to the local market. That's right, they didn't even
give us time to get up and running before they attempted to get the
plan to the other facilities in and around our location. (We feel
this is another fact they knew the machine was never going to
produce to the representation the had provided, thinking lets get
all the equipment we can in that area before our laundry is
exposed). Over the next 11 months there were hundreds of man hours,
email, phone calls, software patches and such when late in the 11th
month we received an email saying our warranty had expired. That was
the result of the Federal Trial as they would not abide by their
terms of Repair, Replace, or Refund!
